Caravan is an e-commerce delivery platform operated by Caravan Delivery, a company registered in the Kingdom of Bahrain, whose registered office is at Building 3698 Road 187 Block 701 Tubli Bahrain. This page together with any and all other documents, terms of use and policies referred to herein (the “Terms”) shall constitute the terms and conditions applicable to you (“User” or “Users”) when using, creating an account with and/or through, entering into, registering with, ordering from or through the Caravan application and any associated Caravan websites and/or applications including without limitation any services offered thereon (the “Platform”).

Please read these terms carefully before creating a Caravan account and/or using the Platform. By accessing and/or using the Platform, you agree to be bound by the Terms and to comply with all the applicable laws and regulations regarding your use of the Platform.

Caravan reserves the right to modify the Terms at any time without prior notice. Your use of the Platform in any manner confirms that you have read, accepted, and agreed to be bound by the Terms and any modifications thereto.

SERVICES

The Platform provides access to and links its’ Users with its partnered restaurants, vendors, groceries and businesses that may be operated by third parties or affiliated companies (“Merchants”) in their area of delivery (“Service”). Users may order a variety of goods including food and non-food items (“Goods”) from Merchants through the Platform. The Platform is an interactive tool and Users may manage their experience throughout the registration and ordering process. Caravan acts as a facilitator on behalf of Merchants to conclude orders from the Platform.

Caravan does not in any way, shape or form interfere with the production of any Goods or services offered or produced by Merchants and made available on the Platform. The Platform merely offers the ability to search for and find local Merchants that deliver these Goods to the User’s registered address and enables the User to order them through the Platform.

Caravan does not verify or guarantee the credentials of, representations made by or the products listed in Merchants’ pages. Caravan does not guarantee the ingredients or the quality of any Goods, products or services offered on the Platform and delivered to Users, nor does it confirm if a Merchant or a Good is in compliance with applicable laws. Caravan may or may not provide ingredient information or allergen information on the Platform and does not guarantee or verify whether a certain good satisfies allergen or specific standards presented by the Merchant or requested by the User on the Platform. Please contact the Merchant directly before placing an order on the Platform if you have any dietary requests. Caravan takes no responsibility or liability for any representation made by a Merchant in this respect, nor is it responsible for ensuring that a particular item is delivered in accordance with dietary requirements requested by a User. Caravan shall not be responsible to replace or refund an order which does not conform to specific instructions provided by a User.

The Merchant and the Platform will do everything they can to meet the delivery time specified, however delivery times may be affected by factors beyond its control and therefore cannot be guaranteed. Caravan will inform you if it becomes aware of an unexpected delay.

CREATING AN ACCOUNT

In order to use the Platform and access the Service, a User must be 18 years of age or older and shall create a Caravan account. The User shall determine their own username and password. The password must be kept private and only known to the User. The User will be solely responsible for usage of his/her account by any other person. The User is responsible for all activities that occur on the Platform through his/her account. The personal information you provide when creating the account may be shared with the Merchant to provide an efficient Service. You confirm that any information provided by you on the Platform is true and accurate at all times.

The Platform and Caravan assume that all information regarding the age of the User is true and accurate and therefore all Users have the required authority to use the Platform and pay for the Services. Any misuse of the Platform in this respect shall be the responsibility of the User.

Permitted Use and Licence

Users are permitted by Caravan (and such permission may be revoked at any time and for any reason) to view the Platform and to download, email, forward, share via social networking or print individual pages from the Platform in accordance with these Terms and solely for the User’s own personal, non-commercial use, provided the User does not remove or amend any trademark, Caravan Logo or copyright contained on such pages. No other use of Intellectual Property is permitted by Caravan.

Users shall not modify, re-publish, transmit, display, reproduce, publish, reuse, resell, license, create derivative works from, transfer, or sell any information, content, material, software, products or services obtained from the Platform, except as specifically permitted above.

Users may not use the Platform for any purpose other than for using the Service. Users may not use the Platform for any purpose which may be deemed illegitimate or unlawful for any intent or purpose by Caravan or applicable law. A User may delete his/her account at any time. In the event that a User deletes his/her account while an Order is pending delivery, the User shall remain liable to accept the Order and settle all dues in relation to the Order in full. Caravan may suspend and/or terminate an account at its discretion at any time and/or commence legal action against the User should it deem that the User is in breach of the Terms. In the event that Caravan suspects that a User is using the Platform for an illegitimate or unlawful purpose, it may also investigate the incident and/or report it immediately to the relevant authorities.

ORDERS

Upon the selection of Goods from the chosen Merchant, the User may submit the order by clicking on the “Checkout” button (“Order”). The User shall check that the information inserted is correct before clicking on the “Checkout” button. Errors cannot be corrected after submitting the order. Once the order is received by the Platform, it will process the order, send it to the relevant Merchant with whom the order was placed and will send the User an email to confirm the order.

Orders shall all be subject to availability. In the event that an item is not available, the User will be contacted and informed accordingly. An alternative may also be offered to the User. Should the User not accept the alternative item, the User may be entitled to a refund for the price of such item.

CANCELLATION

Users may choose to cancel the Order within two minutes of the Order being placed. Once the Order has been processed, the Order may not be cancelled and the User will be liable to pay for the Order in full without any deductions or refunds. Users remain liable for payment in the event that the address provided in the Platform is incorrect and/or the User not reachable/available to receive the Order at the address provided for a period of 15 minutes from arrival.

DELIVERY ORDERS

Availability of Goods and Merchants on the Platform vary depending on the delivery area. Delivery areas may change depending on different conditions such as: weather and traffic.

Delivery Time

Caravan shall deliver your Order to the delivery address provided by you. An estimated delivery time is provided on the Platform. This is an approximation and not a fixed time. Delivery times may vary and change depending on factors and conditions beyond Caravan’s control. Orders may arrive earlier or later.

Unsuccessful or Failed Deliveries

In the event that we attempt to deliver an Order but we are unable to do so, for reasons such as:

  • 1. No one was present or available to receive the Order;
  • 2. Merchant and/or Caravan were unable to connect to the User upon reaching the location for delivery;
  • 3. Access to deliver the Order was denied ;
  • 4. Wrong delivery address.

Caravan reserves the right to cancel the Order without refund or remedy to the User. In the event that the charges for the Order have not been paid at the time of checkout, the User will remain liable to settle the charges in full and measures may be taken to ensure payment is made.

Wrong Order, Missing Order, Defective Items

If there are issues with your Order (i.e. wrong order, defective order, or missing items) please immediately contact customer support via the Platform. Caravan may request photographic proof and/or additional information to properly investigate the issue with your Order. If we determine that the Order and/or goods you received are not of satisfactory condition or quality, we will compensate you for your Order or parts of your Order.

Late Delivery

If your Order is significantly delayed from the estimated delivery time, please immediately contact customer support via the Platform.

Contactless Delivery

Users may choose the contactless delivery option whereby Orders will be delivered to their doorstep without face-to-face interaction. Caravan and the Platform will not be liable for theft, damage, contamination or spoilage of the goods which may occur after delivery has taken place.

User Reviews

Users may review their experience after placing and receiving the Order. Reviews are subject to:

  • - User having first-hand experience of the Good sold through the Platform.
  • - Acceptable content: although Caravan is not obligated to review User comments prior to submitting a review on the Platform, it may reject submissions on the basis of abusive or offensive language, profanity, racism, hate, reference to illegal behaviour, discriminatory and illegal language, and any behaviour which goes against public policy.

Reviews do not represent the views of Caravan and are entirely independent consumer made reviews. Caravan shall not be held responsible for any loss or damage which may arise on reliance of a User on reviews posted on the Platform. Users are not paid to post reviews on the Platform.

PRICE AND PAYMENT

All online payments are processed via your own issuer / payment service provider and the payment service providers in partnership with Caravan.

Prices of Goods and services available on the Platform shall be displayed in the applicable national currency and subject to applicable tax. You accept prices and offers displayed on the Platform as they are regardless of whether they may vary elsewhere. Prices may change at any time.

Caravan reserves the right to charge fees as appropriate or necessary (including but not limited to a delivery fee, service charge etc). The breakdown of the prices and additional charges are displayed before checkout. When you place an Order, you agree to all amounts, additional charges and the final ‘Total’ amount which is displayed to you.

Payment Methods

The User may choose from the different payment methods available on the Platform.

Online payment methods are processed by our third party payment service provider(s). Third party payment service providers may store your information with your consent. This feature may be disabled at any time. If you have chosen to save and/store your payment/financial information as aforementioned, this is entirely and solely at your risk and responsibility. Caravan and any of its affiliates will not be held liable or responsible for any data or security breaches or leaks which may occur on the Platform at any time. The User therefore releases and holds Caravan harmless against any such claim(s) relating to data leaks which may occur on the Platform.

You must ensure that you have sufficient funds on your credit and debit card to fulfil payment of an Order.

CARAVAN LOYALTY PROGRAM

The Caravan Loyalty Program is a tiered loyalty program designed to incentivize Users to continue using the Platform. Users join the loyalty program as soon as they sign up/create account. It is a points rewards scheme that can be availed at certain thresholds to access offers/discounts. A User would be subscribed to different programs based on the orders placed. It operates under a 3-tier system, where the User’s account will be categorized as:

PEARL - Tier 1 (lowest)
SAPPHIRE - Tier 2
EMERALD - Tier 3 (highest)

The current loyalty point’s scheme is as follows:

10 fils spent = 1 point earned
100 fils spent = 10 points earned
BD 1 spent = 100 points earned

For every 100 points earned = 50 fils credited will be credited into a User’s cPocket. Points are burnt as and when redeemed/spent/utilized by the User. The minimum is 100 fils redemption, rounded up to the nearest 100 fils. The history of points redeemed are accessible by the User within the Platform. All data regarding loyalty points is automatically calculated by an algorithmic earning process. These records cannot be modified.

Rules regarding the Caravan Loyalty Program may be amended, revised and/or removed at any time and for any reason at the discretion of the Platform and Caravan. This program is made available to the Users at the discretion of Caravan as it deems fit. Any termination, suspension or limitation of a User’s access to and use of the Platform will not give rise to any liability on Caravan or the Platform with respect to points which a User may accumulate or earn as part of the program.

cPocket

cPocket is a digital points earning service which records points earned by Users and converted into cash value. This service is owned and managed solely by and at the discretion of the Platform. The Platform may terminate, limit or suspend access to cPocket entirely or individually in any event and for any reason without any liability on its part. Users agree and acknowledge that access to cPocket and any and all points/credits therein is at the discretion of Caravan and/or the Platform and may be terminated at any time.

REFUND POLICY

If there are any problems with your Order, please contact Caravan through the Platform as appropriate and our customer support agents will assist you. Caravan may issue full or partial refunds depending on the issue. If you did not receive your Order in full, you will receive a full refund. If an item is missing from the Order, we may issue a partial refund. You will receive your refund in your cPocket.

LIMITATION OF LIABILITY

The Platform and the content available thereon is provided on an “as is” and "as available" basis. Caravan makes no representation or warranty of any kind, express or implied, regarding the content or availability of the Platform, or it will be timely or error-free, or that defects will be corrected, or that the Platform or server that makes it available are free of viruses or other harmful content. Neither Caravan nor its directors, officers, agents, employees or contractors shall have any liability for any direct, indirect, special or consequential losses or damages (including without limitation, damages for loss of business or loss of profits), arising in contract, tort or otherwise from the use or inability to use this Platform. Nothing in these terms shall exclude or limit liability for death or personal injury resulting from Caravan’s negligence or that of its agents or employees.

Caravan hereby disclaims all representations and warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, freedom of and from malware risk, and implied warranties arising from, in connection with or in relation to all goods and services offered, appearing, listed and/or sold on the Platform.

Merchants are solely responsible for the preparation, condition and quality of goods sold to Users. Caravan takes no liability or responsibility for items in this respect.

USER MATERIAL

Other than User identification information (“Personal Data”), which is subject to the Privacy Policy, any material posted or interactions made by Users on the Platform will be considered non-confidential and non-proprietary. By creating a Caravan account and using the Platform, you hereby consent that the Platform may copy, disclose, distribute, and otherwise use or dispose of that material in any way. Therefore all data, images, analytics, sounds, text and other things embodied in the Platform and become part of it and uploaded to it by Users for any intent or purpose relating to Caravan and its affiliates’ commercial operations and Services and uses may be used and disclosed by the Platform to any third party in any shape or form as part of its operations, but in any case subject to the disclosure limits prescribed by applicable law.

AUTHORITY OF CARAVAN

Caravan may without any liability on its part temporarily or permanently suspend or cease operations of the Platform at any time and for any reason.

Caravan may store, delete, back-up or save files from the Platform in any way it deems fit, subject to any applicable law.

Any and all signs, logos, brand names, copyrights and intellectual property relating to and bearing the Caravan name shall be solely owned by Caravan and/or its affiliates as applicable.

All items displayed on the Platform are subject to availability by the Merchant. Caravan and the Platform will not be responsible for any item ordered but not delivered, or delivered but not according to specific requirements requested by the User.

Any material, data, information, customer reviews, satisfaction reports and any other information posted or generated by Users on the Platform (except for personal identification information and payment information which is subject to the privacy policy) may be used and disclosed by the Platform and/or Caravan as it deems fit. Such information shall be deemed solely owned by Caravan and Caravan has the right to use, copy, distribute, sell and disclose to third parties this information and data for any purpose related to Caravan’s business operations. Users shall not demand royalties in such cases.

Services, fees, charges, royalty programs, discounts and/or offers provided on the Platform may be revised, amended, varied and/or cancelled at any time by Caravan at its sole discretion without notice to the Users or any liability on its part for doing so.

The Platform may be unavailable at certain times to allow for maintenance and upgrades. If permitted, Users may be notified in advance of any service unavailability or disruption.

INTELLECTUAL PROPERTY RIGHTS

All material and content on the Platform including but not limited trademarks, logos, images, source codes, databases, functionality, software, website designs, audio, video, text, photographs and graphics (“Intellectual Property”) are owned by Caravan, and are subject to copyright and intellectual property laws applicable in the Kingdom of Bahrain and international treaties relating to the protection of copyright and trademarks. Subject to and within the limits of the permissions granted by Caravan herein, you may not in any manner use, distribute, copy, reproduce, republish, download, upload, broadcast, transmit, make available to the public, or otherwise use or dispose of any Intellectual Property without Caravan’s express written consent. A breach of these terms will result in immediate legal action being taken against the breaching party, including but not limited to injunctive relief to prohibit such misuse of Intellectual Property.

INDEMNITY

You agree to indemnify and hold Caravan, its parent, subsidiaries and affiliates, agents, officers, directors and employees harmless from any claim, demand, damage, expenses and/or costs which may arise or may be incurred in connection with your use or misuse of the Platform and for any infringement of any intellectual property relating to the Platform. This shall survive any suspension or termination of your permissions to use and access the Platform.

AMENDMENT OF TERMS

These Terms may be modified, amended, revised or varied at any time by Caravan. Users shall be subject to the Terms and any amendments thereto at all times once they become Users of the Platform. If you do not agree with any of the Terms (as may be amended from time to time), immediately stop using the Platform and delete your Caravan Account. All rights and obligations of Users in relation to Caravan’s Intellectual Property shall survive any termination or deletion of User accounts on the Platform, whether such termination or deletion is voluntary or involuntary by the User.

TERMINATION OF ACCOUNT AND ACCESS TO PLATFORM

Caravan may terminate, suspend or delete a User’s Account and access to or use of the Platform, including any delivery service provided with respect to an Order, for any reason, in its sole discretion, in the event that Caravan deems that the User is in breach of any of the terms provided herein. Caravan may if at its sole discretion and if appropriate give the User an opportunity to clarify and resolve the issue prior to suspending or deleting the account.

SEVERABILITY

If any clause, term or condition stated herein or forming part thereof is found by any court or administrative body of competent jurisdiction to be invalid, unenforceable or illegal, all other terms and conditions shall remain valid and in full force and effect.

WAIVER

A failure by Caravan not to exercise any of its rights under These Terms shall not be deemed a waiver of that right in whole or in part nor will it bar the exercise or enforcement of such right at any time or times thereafter.

GOVERNING LAW AND JURISDICTION

The Terms shall be governed by and construed in accordance with the laws of the Kingdom of Bahrain. Any dispute arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Bahrain.
